New Iowa Law Bans Intoxicating Hemp Derivatives, Imposes Restrictions on CBD

Governor Kim Reynolds of Iowa recently signed a measure that bans synthetically produced delta-8 THC and other laboratory-made intoxicating compounds. Other popular intoxicating hemp compounds that are banned include THCP, THC-O-acetate, delta-10 THC and THCA.

Data from national poison control centers revealed that between 2021 and 2023, almost 8,000 individuals reported terrible effects after consuming products that contained intoxicating hemp compounds.

The bill, Iowa House File 2605, also limits the use and sale of naturally derived CBD to individuals aged 21 years of age and older. CBD (cannabidiol) is one of the two primary compounds found in the cannabis plant, the other being THC (tetrahydrocannabinol). Unlike THC, CBD is not psychoactive, which means it doesn’t induce a high when consumed.

The bill also restricts consumable hemp products to 10 mg per package and no more than 4 mg of THC per serving.

The legislation, as signed by Reynolds, also:

  • Gives permission to Iowa’s department of Health and Human Services to confiscate products that don’t comply with regulations
  • Creates criminal and civil penalties for businesses that sell consumable hemp prior to registering with the state
  • Makes it mandatory for retailers to include warning labels on all consumable hemp products

In addition, it bans the sale of dried hemp flowers intended for smoking or inhalation, as well as alcoholic drinks that contain THC. This includes any derivatives, analogues or isomers of THC, whether synthesized or naturally occurring.

Legislators stated that the measure was needed to regulate the hemp industry; they also point out that they never intended to legalize intoxicating hemp products when they approved the state’s hemp act a few years ago.

In her statement, Reynolds observed that she signed the bill into law to protect underage persons from intoxicating and dangerous products. She also announced that they had taken steps to ensure that kids who were resistant to some drugs and suffered from medical conditions such as seizures would continue having access to consumable hemp alternatives.

Iowa isn’t the only state implementing regulations for the hemp industry either. States across the country are working to regulate the market for various intoxicating hemp products currently sold in CBD shops, bodegas, convenience stores and other retail outlets in the form of edibles such as gummies.

These retail outlets impose no age limitations on the sale of these products, which are also marketed in packaging that appeals to kids.

States such as Illinois, Virginia, Texas, Louisiana, Connecticut and Indiana have already launched a crackdown on delta-8 THC derived from hemp. These regulatory responses to intoxicants from hemp are being watched by cannabis companies such as Canopy Growth Corp. (NASDAQ: CGC) (TSX: WEED) because they could shape the future of the hemp industry in ways that could also impact the marijuana industry.
