NYPD Erroneously Seizes Hemp Shipment Thinking It Was Marijuana

On November 3, the NYPD conducted a drug raid and confiscated 106 pounds of drugs believed to be marijuana. The two officers from Brooklyn 75th Precinct involved in the drug raid tweeted a photo standing next to more than 50 bags of “drugs.” In the tweet, the Precinct congratulated the Day Tour Sector E who were working closely together with FedEx and other law enforcement agencies to confiscate the drugs and arrest the individual transporting the delivery. But, it turns out that the confiscated drugs were hemp, not marijuana. The hemp was purchased from Fox Holler Farms in New Haven Vermont by Oren Levy, the owner of Green Angel CBD.

Levy told local media that the shipment was packed in boxes, and each box contained documentation from a third party lab showing that the THC levels were within the stipulated levels by the law.

The spokesperson for the Officer of the Deputy Commissioner Public Information, Detective Sophia Mason, said that an investigation is ongoing.

The NYPD Chief of Department, Terence A. Monahan, released a statistics brief of November 6 and told the reporters that the department received information about a large package of marijuana being transported. They went, confiscated it, and arrested the person who tipped the police.

The shipment is at the lab being tested to determine if it is hemp or marijuana, said Monahan.

Monahan further added that the individual did not have a bill of lading to justify the delivery. He also said that the investigation is active and ongoing and that they are cooperating with the office of the Brooklyn District Attorney.

According to a FedEx guide, a bill of lading gives the details of the contents being transported. On November 1, FedEx contacted the Williston Chief of Police, Patrick Foley, about a shipment they believed to contain weed.

According to Foley, FedEx opened two boxes of the shipment whose paperwork included laboratory tests conducted in October. The tests showed that the THC level in the chests was at 0.6%.

Foley told FedEx that the shipment was legal hemp and would not be confiscated by the police. After the shipment was ferried to New York, a FedEx employee tipped the NYPD, who went and confiscated the package and later called Levy to pick it from the Precinct, Levy said.

Levy was recovering from surgery; therefore, he sent his brother Ronen Levy to pick up the shipment only to be arrested immediately after arriving at the precinct. Ronen Levy was charged with an offense of marijuana possession. He was later released and is to appear in court on November 19.

The NYPD is yet to return his shipment, which is valued at $30,000. He is planning on suing the Precinct to get his package back.

Fox Holler Farms is owned by Jahala Dudley and her business partner Buddy Koener. It is their first year growing hemp. Dudley said that their crop is hemp compliant as they followed all the rules by testing it during the growing season and after harvesting.

Analysts think hemp industry players like The Green Organic Dutchman Holdings Ltd. (TSX: TGOD) (OTCQX: TGODF) and Sugarmade Inc. (OTCQB: SGMD) are deeply disturbed that wrongful seizures of hemp still continue long after the crop was legalized.
