Wyoming Resubmits its Hemp Program to the USDA

On Friday, the Department of Agriculture in Wyoming resubmitted its hemp plan to the United States Department of Agriculture (USDA) asking for the authority to regulate the industry as required by the 2018 Farm Bill.

Hemp production in the U.S. was legalized under the 2018 Farm Bill, and on October 31, 2019, the USDA issued the interim final rules. The rules provide a regulatory framework for governing hemp at the federal level, provided the states can request for the authority to regulate hemp in their respective jurisdictions.

States that had already submitted their hemp plans before the federal rules were released were allowed to revise their plans to ensure that they are a better match to the rules framework. The Wyoming Department of Agriculture (WDA) withdrew its original Hemp Regulatory Program plan and revised it according to the interim final rule, and then resubmitted it for review by the USDA.

The USDA has 60 days from the date of resubmission by the WDA to review and determine if the plan is approved or rejected, and if the agency will allow the Wyoming Department of Agriculture to regulate hemp. Once the USDA approves a plan, it remains effective unless the agency revokes or suspends it following the procedures described in the Interim Final Rule, or is the State or Tribe amends their plan.

To ensure that the Wyoming Hemp Regulatory Program plan followed the state’s statutes and federal law, the USDA worked together with the Wyoming Department of Agriculture (WDA), the Attorney General’s office in Wyoming, and Governor Mark Gordon’s office with the primary goal of implementing the program before the 2020 planting season.

The WDA will proceed with preparation for the implementation of a hemp program in Wyoming as the USDA continues Wyoming’s plan review.

Hemp is a Cannabis Sativa L plant, and it can be grown for CBD, hemp seed oil, grain, or fiber. There are significant differences between cultivars during the growing season, such as the plant size, planting density, production system to be used, and the crop value. Hemp can be used to make products such as textiles, topicals, rope, paper, cosmetic products, building materials, and fiber, and it can also be infused into food and beverages.

Meanwhile, the USDA has approved the hemp plans of several Tribes, such as the Colorado River Indian Tribes, Flandreau Santee Sioux, Iowa Tribe of Kansas and Nebraska, Santa Rosa Band of Cahuilla Indians, and Fort Belknap Indian Communities. The states whose plans were approved by the USDA include Delaware, Louisiana, Nebraska, Ohio, New Jersey, and Texas.

Industry watchers believe that hemp companies, such as HTC Extraction Systems (TSX.V: HTC) (OTCQB: HTPRF), see the approval of the hemp plan as a foregone conclusion so farmers and other stakeholders can go ahead and wait for the green light to start their planned activities.
